The Game is provided for your personal, non-commercial use (for entertainment purposes only). You shall not use the Game for any commercial, illegal, or unauthorised purposes, including but not limited to reselling access to the Game’s services, engaging in fraudulent activities, or violating the rights of third parties.

When Using the Game, you must comply with all applicable laws and regulations of your country/region of residence (including but not limited to data protection laws, intellectual property laws, and cybersecurity laws) (collectively "Applicable Laws").

You agree to comply with all Applicable Laws and these Terms when Using the Game. Without limiting the generality of the foregoing, you agree not to:

• (a) Use the Game in any unlawful manner, or in a manner that promotes, incites, or facilitates illegal activity (including without limitation, infringement of intellectual property rights, dissemination of harmful information, unauthorised collection of personal data, or profiting from game vulnerabilities);
• (b) Attempt to gain unauthorised access to the Game’s servers, databases, user accounts, or any computer systems connected to the Game;
• (c) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of any part of the Game; or reformat, frame, or mirror any portion of the Game’s content, except to the extent expressly permitted by these Terms or mandatory Applicable Laws;
• (d) Interfere with or disrupt the operation of the Game, including but not limited to sending excessive requests, introducing malware, using cheats or hacking tools, or exploiting technical vulnerabilities to tamper with game data.

Content

All material contained on, in, or available through the Game (including but not limited to game characters, scenes, sound effects, background music, storyline text, source code, in-game items, and the selection/arrangement of such material) (the "Game Content") is owned by PxWall Games Network Co.,Ltd., its licensors, or third-party content providers (collectively "Content Owners"). All rights in the Game Content (including copyright, trademark rights, patent rights and other intellectual property rights) are reserved by the Content Owners.

You may access and use the Game Content solely for your personal, non-commercial entertainment use in accordance with these Terms. Except as expressly permitted herein, you shall not copy, edit, reproduce, publish, distribute, transmit, store, commercially exploit, or disseminate the Game Content in any form or by any means without the prior written consent of the relevant Content Owner.

All trademarks, service marks, logos, and trade names (the "Trademarks") used or displayed on the Game are the property of PxWall Games Network Co.,Ltd. or its licensors. You shall not use, copy, modify, reproduce, display, distribute, or exploit any Trademarks without the prior written consent of PxWall Games Network Co.,Ltd. or the relevant licensor.

Payment Processing

Payment processing services for paid in-game items, value-added services, or subscription plans (collectively "Paid Content") on the Game are provided by our cooperating third-party payment processors (such as Google Play Payments, Apple In-App Purchase, etc.) (the "Payment Processors"). All payment transactions are subject to the Payment Processors’ terms of service and privacy policies (available on their respective websites). By making a payment through the Game, you agree to be bound by the Payment Processors’ terms and authorise PxWall Games Network Co.,Ltd. to process your payment via the applicable Payment Processor.

You acknowledge that all purchases of Paid Content are voluntary, and no refunds will be provided after purchase (unless mandatory by Applicable Laws or if the Paid Content is unavailable due to game malfunctions). Virtual in-game items and currencies are for use only within the Game, have no real monetary value, and shall not be traded in real-world transactions. PxWall Games Network Co.,Ltd. is not responsible for any errors, delays, or failures in payment processing caused by the Payment Processors, your payment method issuer, or circumstances beyond PxWall Games Network Co.,Ltd.’s reasonable control (e.g., network outages, device malfunctions).

PxWall Games’ Rights & Responsibilities

PxWall Games Network Co.,Ltd. does not guarantee that the Game will be continuously available, uninterrupted, timely, secure, or free from errors, bugs, viruses, or omissions. We may suspend or discontinue the Game (or any part thereof) temporarily or permanently for maintenance, technical upgrades, legal compliance, or business reasons, with or without prior notice.

PxWall Games Network Co.,Ltd. shall not be liable for any third-party websites linked to, or third-party services integrated within the Game (including but not limited to advertising, social sharing, data analytics). We do not endorse any third-party websites or services, and your interaction with third parties via the Game is at your own risk.

PxWall Games Network Co.,Ltd. shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage (including but not limited to loss of game data, account suspension/ban, device damage, loss of profits) arising from:

• The temporary or permanent unavailability of the Game;
• Third-party content or services accessed via the Game;
• Your failure to comply with these Terms or Applicable Laws resulting in account suspension/ban or restriction;
• Unauthorised access to your account (unless caused by PxWall Games Network Co.,Ltd.’s gross negligence or wilful misconduct);
• Events beyond PxWall Games Network Co.,Ltd.’s reasonable control (including but not limited to natural disasters, cyberattacks, government actions, or disruptions to internet services).

Nothing in these Terms limits or excludes PxWall Games Network Co.,Ltd.’s liability for:

• Death or personal injury caused by PxWall Games Network Co.,Ltd.’s negligence;
• Fraud or fraudulent misrepresentation;
• Any liability that cannot be lawfully limited or excluded under Applicable Laws.

The Game is provided on an "as is" and "as available" basis. PxWall Games Network Co.,Ltd. makes no representations or warranties (express or implied) regarding the Game, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. We reserve the right to modify, update, or discontinue features of the Game at our sole discretion, and may offer different features or pricing to different users.

PxWall Games Network Co.,Ltd. will take reasonable technical and organisational measures to protect the security of the Game and your personal data, but we recommend that you use up-to-date antivirus software, keep your device secure, and avoid sharing your account credentials (e.g., username, password).

User Responsibilities

A "User" means any person who accesses or uses the Game (whether registered or unregistered).

Users are solely responsible for:

1. Maintaining the confidentiality of their account credentials (e.g., username, password, verification code, biometric data) and all activities conducted under their account;
2. Ensuring that all information provided to PxWall Games Network Co.,Ltd. (e.g., registration details, payment information) is accurate, complete, and up-to-date;
3. The content they post, upload, or transmit via the Game (including but not limited to game nicknames, avatars, battle record sharing, community comments) (the "User Content"). Users must not post User Content that is defamatory, obscene, discriminatory, illegal, infringing of third-party rights, or in violation of Applicable Laws;
4. Reporting any unauthorised use of their account, or any inappropriate/illegal content on the Game, to PxWall Games Network Co.,Ltd. immediately via contact@pxwallgames.com;
5. Exercising independent judgement regarding the accuracy, completeness, or suitability of any Game Content or information on the Game (PxWall Games Network Co.,Ltd. does not guarantee the accuracy of user-generated content or third-party resources);
6. Complying with all Applicable Laws and these Terms when Using the Game;
7. Not using the Game to solicit, promote, or advertise products/services of third parties (except with PxWall Games Network Co.,Ltd.’s prior written consent);
8. Not using cheats, hacking tools or other illegal software, or attempting to bypass PxWall Games Network Co.,Ltd.’s payment or security systems.

Any User who breaches these Terms may have their account suspended, restricted, or permanently banned, and may be prohibited from future use of the Game. PxWall Games Network Co.,Ltd. reserves the right to take technical measures to stop violations without prior notice.

The Game is not intended for use by individuals under the age of 10. If you are between 10 and 18 years of age, you may use the Game only with the supervision and consent of a parent or legal guardian, who shall be responsible for your compliance with these Terms. If you assist a minor under 10 to use the Game, you assume full liability for any consequences arising from such use, and PxWall Games Network Co.,Ltd. shall not be liable for any loss or damage resulting therefrom (except where such liability cannot be lawfully excluded).

Third Party Content, Advertising and Websites

The Game may contain links to third-party websites, or display third-party advertising, content, or services. These links and content are provided for your convenience only, and PxWall Games Network Co.,Ltd. does not control or endorse any third-party websites, content, or services. Your access to third-party websites is at your own risk, and you shall comply with the third parties’ terms of service and privacy policies.

PxWall Games Network Co.,Ltd. is not responsible for any loss or damage arising from your interaction with third-party content, advertising, or websites, including but not limited to fraud, data breaches, or harmful content. If you encounter offensive or inappropriate advertising on the Game, please report it to contact@pxwallgames.com, and we will review and take appropriate action (where possible).

Intellectual Property

All intellectual property rights (including copyright, trademarks, patents, and trade secrets) in the Game (including its code, design, functionality, and Game Content) are owned by PxWall Games Network Co.,Ltd. or its licensors. You acquire no rights in the Game or Game Content other than the limited right to use the Game in accordance with these Terms.

You acknowledge that the Game may allow you to create user-generated content (e.g., game nicknames, avatars, battle record sharing, community comments) ("UGC"). By posting or submitting UGC to the Game, you grant PxWall Games Network Co.,Ltd. a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, adapt, distribute, and display the UGC for the purpose of operating, maintaining, and improving the Game. You represent and warrant that:

• You own or have the right to grant the licence to the UGC;
• The UGC does not infringe any third-party intellectual property rights, privacy rights, or Applicable Laws;
• You will indemnify PxWall Games Network Co.,Ltd. against any claims, losses, or damages arising from a breach of this warranty.

PxWall Games Network Co.,Ltd. may remove any UGC that infringes third-party rights or violates these Terms, at our sole discretion and without notice.

Disclaimers and Limitation of Liability

Nothing in these Terms limits or excludes PxWall Games Network Co.,Ltd.’s liability for:

• Death or personal injury caused by PxWall Games Network Co.,Ltd.’s negligence;
• Fraud or fraudulent misrepresentation;
• Any liability that cannot be lawfully limited or excluded under Applicable Laws.

You must notify PxWall Games Network Co.,Ltd. of any claim or dispute arising from your use of the Game within 30 days of becoming aware of the issue, and provide PxWall Games Network Co.,Ltd. with a reasonable opportunity to remedy the issue before taking any legal action or incurring costs to remedy the issue yourself.

If you are a User (non-consumer), PxWall Games Network Co.,Ltd.’s total liability for any claim arising from or related to the Game (including negligence) shall be limited to the lesser of:

• The total amount you paid to PxWall Games Network Co.,Ltd. for use of the Game in the 12 months prior to the claim; or
• £200.

PxWall Games Network Co.,Ltd. shall not be liable for any indirect, consequential, special, or incidental losses (including but not limited to loss of profits, loss of goodwill, loss of data, or business interruption), even if PxWall Games Network Co.,Ltd. was aware of the possibility of such losses.

If you are a consumer (as defined by the Consumer Rights Act 2015), nothing in these Terms shall affect your statutory rights.

This agreement constitutes the entire understanding between you and PxWall Games Network Co.,Ltd. regarding your use of the Game, and supersedes all prior oral or written agreements, representations, or understandings between the parties.

Changes to the terms and conditions

PxWall Games Network Co.,Ltd. may revise these Terms from time to time, at our sole discretion. We will notify you of material changes by posting the revised Terms on the Game, or by sending you an email (if you have provided contact details). The revised Terms will take effect 14 days after notification, or immediately if required by law. You are required to check the latest version of the Terms through the Terms of Service entry in the Game’s Settings page on your own initiative. Your continued use of the Game after the effective date of the revised Terms constitutes your acceptance of the changes.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of your country/region of residence. Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiation between the parties; if negotiation fails, either party may submit the dispute to the competent court of the place where the defendant is domiciled, in accordance with Applicable Laws.

If any clause or part of these Terms is found to be invalid, unenforceable, or illegal, the remaining clauses shall remain in full force and effect.
